Access to and navigation on the website, or the use of its services, implies the express and complete acceptance of each and every one of these General Conditions, including both the Specific Conditions established for certain promotions and the Privacy and Cookies Policy, relating to the purposes of the processing of the data you provide us. Please, we recommend that you read them carefully.

Access to the website www.mimshopoki.com implies the express acceptance by the User of these General Conditions of Use, which may be modified or replaced by its owner at any time and without prior notice.

2.- General Conditions of Use.

The following General Conditions regulate the use and access to the Web portal, the purpose of which is to be the gateway to MIMOKI DESIGN, SL , offering users information, services and content via the Web. Through the website, the User has access to information on specific products and services, tools and applications.

The User undertakes to make appropriate use of the content, services, applications and tools that are accessible, subject to the Law and these General Conditions of Use and, where applicable, to the Specific Conditions that may be established for access to certain services and applications, respecting at all times the other Users of the same.

In the event of total or partial non-compliance by the User with these General Conditions of Use, MIMOKI DESIGN, SL reserves the right to deny access to the User without prior notice.

2.2.- General Terms and Conditions and Return Policy .

- PRICES INDICATED ON THE WEBSITE: All prices of the products offered on the Website are expressed in EUROS (€) and include VAT. Changes in prices on the Website will not affect those orders that have been confirmed and completed by the User.

- SHIPPING: Shipping costs will depend in all cases on the destination area, according to the following table:

-DELIVERY TIMES : Delivery times outside the Iberian Peninsula will depend on the carrier, so the customer will receive an email with the link and tracking number once the order is processed; within the Peninsula the delivery times are as follows:

a) GUEST AND BRIDAL HEADGEAR, BAGS: 20 to 25 business days from when the order is placed online and delivered to the indicated address.

b) CLOTHING, SHOES AND ACCESSORIES: 2 to 5 business days in the Peninsula, if in stock at the time the order is placed.

- PAYMENT FOR PRODUCTS : the entity wants to guarantee secure payment by Users. Therefore, the only payment option will be by credit/debit card and/or Paypal.

- RIGHT OF WITHDRAWAL: Users have the right to proceed with the exchange or refund of the amount of the order processed through the Website within a period of 14 calendar days from the User's receipt of the product, provided that the items have not been used and are in the same condition in which they were received.

It is essential that the item is in perfect condition, has not been used, has all its labels unremoved and is in its original packaging.

To do so, you may use the withdrawal form that you will find in Annex I to these conditions and that you must send through one of the contact methods provided, or send, within the indicated period, an email to the address ecommerce@mimshopoki.com expressing their will to withdraw in a reliable manner.

- ONLINE EXCHANGE AND RETURN POLICY:

If you are not satisfied with your online purchase, you have 14 calendar days after receiving your order to request a return or exchange it for another size, color or model.

It is essential that the item is in perfect condition, has not been used, has all its labels unremoved and is in its original packaging.

Changes and returns of personalized, custom-made or altered products are not accepted. Except for defective items.

IN-STORE RETURN OF ONLINE ORDERS

Visit our store in Madrid, located at Conde de Aranda 8, and deliver the item you wish to exchange or return. If it is a return, the full amount of the order will be refunded.

HOME COLLECTION ON THE PENINSULA

*exclusive service for the Iberian Peninsula

You have 14 days to request home collection and we will send a courier to collect your package or exchange it for a different one.

Request a pick-up or exchange at ecommerce@mimshopoki.com or via WhatsApp 602252687. Pack the items securely. The carrier will come to your home to pick up the product or to make the exchange (the same carrier that delivers the exchange will pick up the item to be replaced).

The price of this service on the peninsula for both an exchange and a return is €8.

Once we have received the product at our office and verified that the item is in perfect condition, we will proceed to refund the amount of the item.

- CLAIMS: If the consumer considers that his/her rights have been violated, he/she can contact us via email ecommerce@mimshopoki.com to request an out-of-court settlement of disputes. In this regard, in accordance with EU Regulation No. 524/2013, we inform you that you have the right to request such out-of-court settlement of consumer disputes through the Internet address: https://ec.europa.eu/consumers/odr/

- HEADGEAR RENTAL:

Renting headdresses through our website means paying the full rental price at the time of ordering.

In addition, by default, you will have to request both home delivery and collection at the same address, with Mimoki being responsible for this service. The cost will be €6.50 one way and €6.50 return, a cost that is borne by the consumer.

When making the rental you will have to select the Saturday of the wedding week. 

The delivery person will deliver your order on Thursday, of the same week as the selected Saturday, to the address provided by the customer during the payment process. The return will then be collected on Monday, of the following week, at the same address as the delivery. 

Before preparing the shipment of the headdress, we will send you a link via email to pay the deposit. This deposit consists of a 100€ hold which will be automatically released once we have received the headdress back in our store and checked that everything is in perfect condition. In the event of any damage, we will deduct the corresponding part from the deposit.

If you wish to change the headdress model, this will be possible at a cost of €5. To do so, you can contact us by email or through our telephone number.

You can cancel the headdress 2 days before shipping and the corresponding amount will be refunded along with the shipping cost paid.

3.- General Obligations of the User.

The User, by accepting these General Conditions of Use, expressly agrees to:

- Not to take any action intended to harm, block, damage, render useless, overload, temporarily or permanently, the functionalities, tools, content and/or infrastructure of the website, in such a way as to prevent its normal use.

- Safeguard and maintain the confidentiality of the access keys associated with your User name, being responsible for the use of said personal and non-transferable access keys by third parties.

- Do not introduce or create content that is insulting or slanderous, whether of other Users or of third-party companies other than MIMOKI DESIGN, SL .

- Not to use any of the materials and information contained in this Website for illegal purposes and those expressly prohibited in these General Conditions of Use, as well as the specific conditions that, where applicable, are established for certain applications and/or utilities and that are contrary to the rights and interests of MIMOKI DESIGN, SL , its users and/or third parties.

- Do not offer or distribute products and services, or carry out advertising or unsolicited commercial communications to other Users and visitors of MIMOKI DESIGN, SL

The User shall be liable for all damages of any kind that MIMOKI DESIGN, SL or any third party may suffer as a result of the breach of any of the obligations to which it is subject by virtue of these “General Conditions of Use” or the law in relation to access and/or use of the page.

4.- Intellectual and Industrial Property.

The website, the pages it comprises and the information or elements contained therein (including texts, documents, photographs, drawings, graphic representations, among others), as well as logos, brands, trade names or other distinctive signs, are protected by intellectual or industrial property rights, of which MIMOKI DESIGN, SL is the owner or holds authorization for their use and public communication from the legitimate owners thereof.

The User undertakes to use the contents diligently and correctly, in accordance with the law, morality and public order. MIMOKI DESIGN, SL authorises the User to view the information contained on this website, as well as to make private reproductions (simple downloading and storage on their computer systems), provided that the elements are intended solely for personal use. In no case will this imply an authorisation or licence on the property rights of MIMOKI DESIGN, SL or the legitimate owners thereof.

The User is not authorized to proceed with the distribution, modification, transfer or public communication of the information contained in this Website in any form and for any purpose.

Connections and links to third party websites or pages have been established solely as a convenience for the User. MIMOKI DESIGN, SL is not, under any circumstances, responsible for them or their content.

MIMOKI DESIGN, SL assumes no liability arising from the existence of links between the contents of this site and content located outside of it or any other mention of content external to this site. MIMOKI DESIGN, SL does not guarantee continued access, nor the correct display, download or use of the elements and information contained in the portal pages, which may be impeded, hindered or interrupted by factors or circumstances beyond its control or beyond its control, or those produced by the existence of computer viruses on the Internet.

MIMOKI DESIGN, SL assumes no responsibility for any damages, losses, claims or expenses arising from:

9.- Legislation.

This Legal Notice and its terms and conditions shall be governed by and construed in accordance with Spanish law. The user agrees that the competent courts by default to hear any legal action arising from or related to these conditions, or to the use of this Site or the navigation carried out on it, shall be the Spanish Courts.

If any clause or section of these General Conditions, which is not essential to its existence, is declared void or inapplicable, the validity of the remaining clauses will not be affected.
